Visitor Terms and Conditions


Introduction

By purchasing an entry ticket, you agree to the terms and conditions of the Falconcrest raptor park. These describe the rights and obligations of both the park and the visitor has. Below you will find the full terms and conditions.

General

Falconcrest raptor park will within reasonable limits, do everything possible to make the visit to the park complex, and the Falconcrest organized airshows and activities in accordance with the wishes of the visitor. The Falconcrest raptor park endeavors to avoid any nuisance or inconvenience to visitors, as well as ensuring the safety of the visitor as much as possible.

1. General provisions: definitions

Article 1.1

By the 'park' and the 'Falconcrest raptor park' is understood the organization that manages the park complex and operates, including, but not limited to, management and other park staff responsible on behalf of this organization to act in and on it's behalf.

Article 1.2

By 'the park complex' is meant all spaces (cultivated and uncultivated) that fall under the legal or management authority of the supervisor of the Falconcrest raptor park, including but not limited to, raptor flight areas, auditorium and meeting rooms, restaurant, coffee room, terrace, garden, park, and other outdoor areas.

Article 1.3

Under "Visitor" is understood, any person, whether or not (in)directly Falconcrest raptor park has an agreement with the aim to enter the park complex and / or to visit the flight sows or to attend an activity that Falconcrest raptor park plans for the regular visitor during the regular opening hours.

Article 1.4

These general conditions shall apply to any agreement between Falconcrest raptor park and a visitor. The conditions do not apply to special activities outside the regular hours and / or focus on other than the regular visitor, such as space rental, catering and the likes.

2. Tickets, offers and pricing

Article 2.1

All the Falconcrest raptor park quotations, communications or other information are binding. The Falconcrest raptor park accepts liability for mistakes made by the park in the visitor's quotations, communications or other information. This liability applies only to own information found within the park that is available at the time of the claim, that was recently published by or on behalf of the Falconcrest raptor park. The Falconcrest raptor park is not liable for errors due to design, errors or negligence of third parties.

Article 2.2

The visitor is always obliged to present on request, the ticket and any card or voucher that entitles the holder to a discount on the price, to including but not limited to, officials of Falconcrest raptor park.

Article 2.3

The potential visitor is not entitled to obtain a refund of the price or any other compensation in case of loss or theft of the ticket before he enters the park complex. If a potential visitor does not use ticket purchased in advance then it is for the account and risk of the visitor, this is also the case if the ticket is only valid for a certain time or date. An obtained a ticket may not be exchanged. There is also no restitution of the price. The price paid may be refunded if circumstances beyond the influence of the purchaser prior to the park visit, however this for sole evaluation and determination by the supervisor.

Article 2.4

The potential visitor can be denied access to the park complex if it appears that the ticket, the coupon or voucher was not obtained from the Falconcrest raptor park or a by the park empowered birds of prey representative.

Article 2.5

The Falconcrest raptor park reimburses the visitor paid entrance fee and travel costs only if the visitor must leave the park complex because of an unannounced exercise in the context of the Company (Article 23 Health Act), as well as in the case of an actual disaster whereby the park complex is fully or partially evacuated.

3. Stay in the park complex

Article 3.1

During the stay in the park complex, the visitor must conform with and to public order, morality and decent behavior. The visitor is also obliged to follow instructions given by, including but not limited to, the staff of Falconcrest raptor park, managers. If in the reasonable opinion of a duly authorized officer of the Falconcrest raptor park, the visitor act or behave in any way contrary to these standards, instructions or requests, then the visitor can be denied further access to the park complex, without any right to reimbursement of the cost of the ticket or any other costs incurred.

Article 3.2

Parents or supervisors of children are at all times responsible and accountable for the conduct of their children. Teachers and group leaders are responsible and accountable for the conduct of their guided group.

Article 3.3

It is also prohibited that visitors:
a. to offer goods to third parties of any kind, for sale or free;
b. deliberately block the view of exhibited birds for other visitors;
c. be sources of nuisance and noise and use of such equipment like portable hi-fi equipment;
d. (domestic) animals unless on a leash and under the supervision of the owner, in certain cases the are explicitly permitted like for (blind) dogs, with a visitor guide identificatiepass;
e. Touching exhibited objects, birds of prey, displays and exhibition material, lighting, bulkheads and similar, unless expressly and explicitly permitted. Parents or child supervisors should strictly ensure that exhibited objects and birds of prey are not touched by their children. Small children must be taken by the hand or by buggy to be transported, similarly for teachers and supervisors of groups ensure that the exhibited objects and animals are not touched.

Article 3.4

In special cases where the general safety of persons is at stake, a senior official of the Falconcrest raptor park, which as such should be identifiable by means of eg a badge, may on request search the visitors (hand)luggage. If it is deemed necessary,specially trained staff may also requests the visitor when entering or leaving the park complex, perform a security search. The potential visitor will be warned that this measure is of forcet when entering the park complex

Article 3.5

The visitor is prohibited from making commercial photography, video and / or film. Unless prior written permission of the management of the Falconcrest raptor park has been obtained.

Article 3.6

TThe visitor during one or more previous visits to a Dutch park complex, damaged an object or animal deliberately, or otherwise supports the fear that damage wiull be done, will be refused access to the park complex for good or for a certain period of time. His visits are subject to the measures listed in Article 3.4 of this Terms and Conditions. The decision on denial of access must be justified and visitor immediately informed, if possible in writing.

4. Complaints and Claims

Article 4.1

The Falconcrest raptor park will do for the visit to the park or complex by the Falconcrest organized raptor raptor park shows and activities in accordance with the published offer to expire, it includes the obligation to inform the public as possible about whole, partial or early closure of the park complex and / or the Falconcrest park raptor organized shows. Furthermore, give the Falconcrest park raptor potential public nuisances offending maintenance, alterations or the (re) establishment of areas, as well as poor weather conditions. The visitor can this not be an entitlement to damages them.

Article 4.2

Reimbursment is not possible with regard to the next, not by the Falconcrest raptor park to avoid complaints and conditions, and thus never lead to any obligation for compensation by the park to the visitor:
a. complaints relating to the birds not visible from the permanent collection of the Falconcrest raptor park;
b. complaints relating to the closed part of the park complex, including, but not limited to, partial closure due to building or dismantling of exhibitions;
c. complaints and circumstances relating to nuisance or inconvenience caused by other visitors, including but not limited to, noise, inappropriate behavior, theft and harassment;
d. complaints and circumstances relating to nuisance or inconvenience caused by maintenance work, including but not limited to, a conversion of the (re) establishment of areas;
e. complaints and circumstances relating to nuisance or inconvenience caused by the malfunctioning of facilities in the park complex;
f. complaints and circumstances relating to the cancellation of bird of prey exhibition and / or air shows because of adverse weather conditions.

Article 4.3

Complaints and requests to recover on the agreement between Falconcrest raptor park and the visitor within six weeks after the visit has taken place, written Falconcrest raptor park accessible. Complaints and requests for advertising after this deadline will not be in treatment taken. A complaint form is available at the reception of the park.

Article 4.4

The Falconcrest raptor park investigate the complaint and respond in writing within 30 days of receipt. Is the investigation still ongoing, this is communicated to the complainant, and the probable time when that is the case.

Article 4.5

The visitor can complaints, complaints and suggestions to improve writing by completing a form available at the reception of the park.

5. Liability of Falconcrest raptor park

Article 5.1

For damage caused by the Falconcrest park raptor and / or third parties to provide visitor estimates, notices or other forms of information, the Falconcrest raptor park never liable, unless and to the extent such damage is the direct result of intention or gross negligence of the Falconcrest raptor park and / or its employees.

Article 5.2

The stay of visitors in the park complex for its own account and risk. The park is only liable for the visitor if and / or consequential damage or injury inflicted to the visitor is the direct and exclusive result of intentional or grossly fault of the park, with the provision that only those claims for reimbursement, which the park is insured for, or are reasonably, according to the insurance.

Article 5.3

In no case is the Falconcrest raptor park required to compensate a higher amount than:
a. the actual price paid and actual expenses or, if that is higher;
b. the insurer of the Falconcrest raptor park at the Falconcrest raptor park for the damage amount paid, or
c. the matter of the claims of another third party.

Article 5.4

For damages caused to vehicles of the visitor, Falconcrest raptor park is never liable, except if and insofar as the damage was incurred on or in the park complex and the direct damage caused by intent or gross negligence of the Falconcrest raptor park and / or employees.

Article 5.5

The Falconcrest raptor park is never responsible for (in)direct damage, incurred as (in)direct result of any defect, any quality or circumstance in or on any property which is under control of the Falconcrest park raptor keeper, lessee, tenant or owner, or otherwise made available to the Falconcrest raptor park state, except if and insofar as the damage directly resulting from intentional or gross fault of the Falconcrest raptor park and / or its employees.

Article 5.6

If the Falconcrest raptor park receives goods or merchandise in any way anywhere by anyone to be filed, stored and / or looked after without the Falconcrest raptor park receiving compensation, then Falconcrest raptor park is not liable for damage to or in connection with goods in any way unless the Falconcrest raptor park intentionally inflicted harm or injury resultant from gross negligence of the Falconcrest raptor park.

Article 5.7

The total liability of the Falconcrest raptor park attributable failure in the fulfillment of the visit agreement is limited to compensation of direct damages and shall in no case exceed the compensation scheme described in 5.3.

Article 5.8

In case of damage causing death or bodily injury, the total liability of the Falconcrest raptor park in no event exceed the compensation scheme described in 5.3.

Article 5.9

Liability of the Falconcrest raptor park for indirect damage, including consequential damages, lost profits or wages, lost savings, etc., is excluded.

Article 5.10

In Article 5.3 above mentioned maximum lapse if and insofar as the damage caused by intent or gross negligence of the Falconcrest raptor park or one of its officials.

6. Force Majeure

Article 6.1

Force majeure for the Falconcrest raptor park, which means that any deficiency caused by the Falconcrest raptor park can not be appropriated, applies to any unforeseen circumstance that prohibits the execution of the agreement by the Falconcrest raptor park, temporarily or permanently, making the execution of the contract impossible or extrmemly difficult.

Article 6.2

Under such circumstances, include circumstances involving persons and / or services and / or institutions and / or weather on the Falconcrest raptor park uses in the conduct of the visit agreement, and everything before that as force majeure or suspension or cancellation requirement, and attributable shortcoming of the above.

7. Lost and Found

Article 7.1

Found objects can be handed in to the park reception.

Article 7.2

The Falconcrest raptor park will endeavors to locate the owner or holder of the found object, by means of regular contact with local police. Found objects that, after half a year in custody at the Falconcrest raptor park, have not been requested by the owner or person, are entitled to and given to the local police.

Article 7.3

If the owner or holder of a found object reports in, to remove the goods or have them forwarded. In both cases, the owner or person must be able to identify themselves properly.

8. Other conditions

Article 8.1

The applicability of these Conditions is without prejudice to potential applicability of other (contractual) and / or agreements of Falconcrest raptor park.

9. Applicable law

Article 9.1

The Dutch version of the terms and conditions overrules this English version. No legal rights of any nature may be associated with this English translation.

Article 9.2

For all the Terms and Conditions between the visitor and the Falconcrest raptor park, Dutch law applies.

Article 9.3

All disputes arising from the agreement between the visitor and the Falconcrest raptor park, will be dealt with before the court of jurisdiction in Eindhoven.
